Terms and Conditions (T&C) – Duty Free Terms and Conditions (T&C) – Duty Free

These Terms & Conditions (“T&C”) are an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000 and the rules made thereunder and the amended provisions pertaining to electronic documents/records in various statutes as amended by the Information Technology Act, 2000. These T&C do not require any physical, electronic, or digital signature.

This document is published and shall be construed in accordance with the provisions of rule 3 (1) of the Information Technology (Intermediaries’ Guidelines) Rules, 2011 prescribed under Information Technology Act, 2000 that require publishing the rules and regulations, Our privacy policy and user agreement for access or usage of the website.

These T&C are a legally binding document between Relevant Duty-Free and User (both terms defined below). These T&C use will be effective upon your acceptance of the same (directly or indirectly in electronic form or by means of an electronic record) and will govern the relationship between the Relevant Duty-Free and User for the use of the website (defined below).

Please read these T&C carefully. By using the website, you indicate that you understand, agree and consent to these T&C. If you do not agree with the these T&C, please do not use this website. You hereby provide your unconditional consent or agreement to as provided under section 43a and section 72a of Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines) Rules, 2011.

These T&C of the website located at the URL https://www.adanione.com, mobile sites or mobile application (“Website”) is between Adani Digital Labs Private Limited (“ADL” or “We” or “Us” or “Our"), a Company incorporated under the laws of India with its registered office situated at Adani Corporate House, Shantigram, Ahmedabad and the guest users or registered users of the Website ("You" or "Your" or "Yourself", “User” or "Customer") describe the terms on which the offers You access to the Website and such other services as are incidental and ancillary thereto.

These T&C is a contract between You and ADL. These T&C shall be read together with the privacy policy or other terms and condition with all other notices, disclaimers, guidelines appearing on the Website from time to time (collectively referred to as "Agreement(s)") constitute the entire agreement upon which You are allowed to access and use the Website and avail the services.

We act as a facilitator and merely provides an online platform to the User to select the services being offered by the service provider. The details available on the Website is only for the use and information purpose and there is no advertisement, personal communication, solicitation, invitation, or inducement of any sort whatsoever by us to solicit any sales of liquor through the Website.

The present T&C are with respect to the Duty-Free Shops being operated at Ahmedabad, Lucknow, Mangalore, Mumbai, and Jaipur International Airport (herein after referred to as “Relevant Duty-Free Shops”).

Personal information:

We are dedicated to protecting the privacy and confidentiality of your personal information. We never rent or sell your details to any third party. Your data is stored securely on our database and will only be disclosed to our trusted partners upon your express consent for your better experience in using our App, products & services.

Eligibility

  • Only Customers who are in the age limit or older as mentioned below, may use the Website for the purchase of alcohol –
    • Lucknow Airport 21 Years
    Thiruvananthapuram Airport 23 Years
    Jaipur Airport 18 Years
    Mangalore Airport 18 Years
    Ahmedabad Airport 21 Years
    Mumbai Airport 25 Years

    and 18 years or older is the age limit for the purchase of tobacco.

  • We reserve the right to refuse access to the Website/Mobile Application, if it is brought to Our notice or if it is discovered that You are under age for the purchase of alcohol and tobacco.
  • In case of misrepresentation, a legal action might be taken against the user as per the laws of the land.

Order and acceptance

  • Kindly note that we are only providing an online platform service for the Customer and Relevant Duty-Free Shops to connect with each other. ADL does not, at any point of time, during any of the transaction between the Customer and Relevant Duty-Free Shops take ownership of any of the products and services offered at Relevant Duty-Free Shops.
  • Each order submitted constitutes an offer to purchase products. Orders are subject to Relevant Duty-Free Shops acceptance and may be refused at Relevant Duty-Free Shop’s sole discretion in event of following but not limited to:
    • If a valid confirmation code is not received by the Customer.
    • Failure in processing Orders due to an error in information provided by the Customer.
    • The delivery of the product is subject to production of confirmation code generated by Relevant Duty-Free Shops, boarding pass, and the passport of the Customer. Failure to produce any of these will result in refusal to deliver/cancellation of the Order.
    • After Relevant Duty-Free Shops receives an order, the Customer will receive an email confirming receipt of the order. If You do not receive an email, contact Relevant Duty-Free Shops before trying to place another order for the same product.
    • All payments as mentioned and confirmed by Relevant Duty-Free Shops shall be paid through the Mobile Application only.
    • We act as an intermediary and an aggregator for providing state of art digital infrastructure to the respective Duty-Free shops. We neither sell the products nor receive payment towards the products available at the respective Duty-Free shops.

    If you have any questions, comments, or concerns regarding Relevant Duty-Free Shop’s order acceptance policy, or if you consider that your order was rejected in error, please contact Relevant Duty-Free Shops.

Refund policy

  • Relevant Duty-Free Shops accepts refunds subject to the following terms and conditions:
  • Claims made within 30 days from date of purchase.
  • The original/email invoice should be produced / submitted at the time of making any claim(s).
  • No cash refund would be issued against any merchandise.
  • Any offer/scheme running at the time when initial merchandise was purchased would not be applicable on exchange / refund.
  • Relevant Duty-Free Shops as well as ADL reserves right:
    • To request identification
    • To determine whether the merchandise has been damaged, abused or used.
  • Any finding of Relevant Duty-Free Shops regarding damage, abuse, or usage of merchandise by You shall be final and cannot be contested or disputed further.
  • For further details please contact the duty manager of the Relevant Duty-Free Shops or write to support@adanione.com.
  • The amount will be refunded/reimbursed to the same payment mode (i.e., Credit Card/Debit Card/Net Banking, etc.) through which transaction was completed.
  • The refund for products which meet the refund criteria explained above will be processed within three to four working weeks or specified as per the card merchant/ Bank.
  • The Relevant Duty-Free Shops will not issue refund for any perishable items, raffle tickets, pre-paid cards, and high value items where there is difficulty in guaranteeing the authenticity.

No warranties

The Website/Mobile Application and the services are provided on an "as is" basis. We do not make any other representations or warranties of any kind, express or implied, including without limitation that the Website/Mobile Application or the services will meet Your requirements, will always be available, accessible, uninterrupted, timely, secure, or operate without error.

Indemnity

You shall indemnify and hold harmless Us, and Our owner(s), licensee(s), affiliate(s) (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable fees of attorneys', made by any third party or penalty imposed due to or arising out of Your breach of these T&C, our privacy policy and other terms and conditions, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

Limitation of liability

In no event shall We be liable for any special, incidental, indirect, or consequential damages of any kind in connection with these T&C, even if the User has been informed in advance of the possibility of such damages. For example, you waive nominal damages, liquidated damages, statutory damages, consequential damages, presumed damages, as well as the imposition of costs and attorney’s fees.

Governing law and jurisdiction - Mumbai

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Mumbai.

Governing law and jurisdiction - Ahmedabad

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Ahmedabad.

Governing law and jurisdiction - Jaipur

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Jaipur.

Governing law and jurisdiction - Lucknow

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Lucknow.

Governing law and jurisdiction - Thiruvananthapuram

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Thiruvananthapuram.

Governing law and jurisdiction - Mangaluru

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Mangaluru.

The terms and conditions of the Website shall be read in conjunction with that of the Relevant Duty Free.
