Terms and Conditions (T&C) – Parking Terms and Conditions (T&C) – Car Parking

These Terms & Conditions (“T&C”) are an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000 and the rules made thereunder and the amended provisions pertaining to electronic documents / records in various statutes as amended by the Information Technology Act, 2000. These T&C do not require any physical, electronic, or digital signature.

 This document is published and shall be construed in accordance with the provisions of rule 3 (1) of the Information Technology (Intermediaries’ Guidelines) Rules, 2011 prescribed under Information Technology Act, 2000 that require publishing the rules and regulations, Our privacy policy and user agreement for access or usage of the website.

Please read these T&C carefully. By using the website, you indicate that you understand, agree and consent to these T&C. You hereby provide your unconditional consent or agreement to as provided under section 43a and section 72a of Information Technology Act, 2000, the Information Technology (Intermediary Guidelines) Rules, 2011 and a.

These T&C of the website located at the URL https://www.adanione.com, mobile sites or mobile application (“Website”) is between Adani Digital Labs Private Limited (“ADL” or “We” or “Us” or “Our") and the guest users or registered users of the Website ("You" or "Your" or "Yourself", “User” or "Customer") describe the terms on which You access the Website and such other services as are incidental and ancillary thereto.

These T&C is a contract between You and ADL. These T&C shall be read together with the privacy policy or other terms and condition with all other notices, disclaimers, guidelines appearing on the Website from time to time (collectively referred to as "Agreement(s)") constitute the entire agreement upon which You are allowed to access and use the Website and avail the car parking services. These T&C are subject to change/modification without any prior intimation to the User. Users are advised to check for updates on the Website.

We act as a facilitator and merely provides an online platform to the User to select the car parking services (self-parking or valet parking) being offered by the Relevant Car Parking. The details available on the Website is only for the use and information purpose and there is no advertisement, personal communication, solicitation, invitation or inducement of any sort whatsoever by Us.

The present T&C are with respect to the relevant Car Parking available and being operated at Ahmedabad, Guwahati, Lucknow, Mangalore, Mumbai, Thiruvananthapuram and Jaipur Airports. (herein after referred to as “Relevant Car Parking”).

Personal information:

  • We are dedicated to protecting the privacy and confidentiality of your personal information. We never rent or sell your details to any third party. Your data is stored securely on our database and will only be disclosed to our trusted partners upon your express consent for your better experience in using our App, products & services. You may refer to the Privacy Policy available on the Website for more details.

Our Role and Limitation of Liability:

  • We are only providing an online platform service for the Customer and Relevant Car Parking to connect with each other. ADL does not, at any point of time, during any of the transaction between the Customer and Relevant Car Parking take ownership of the car parking services offered at Relevant Car Parking.
  • ADL shall not, at any point of time, be held responsible for safety or security of vehicles including but not limited to any belongings available in the vehicle at time of availing car parking services offered at Relevant Car Parking.
  • All confirmed booking shall only be valid for the time period mentioned on Your booking confirmation.
  • In case of an overstay after expiry of booking time, the additional differential amount will be collected at the payment booth upon exiting the Relevant Car Parking.
  • Each booking submitted constitutes an offer to avail the car parking services of the Relevant Car Parking. Bookings are subject to Relevant Car Parking acceptance and may be refused by Relevant Car Parking’s sole discretion in event of following but not limited to:
    • Failure in processing bookings due to an error in information provided by the Customer.
    • The car parking services can be availed subject to production of booking confirmation generated and shared by Relevant Car Parking to the Customer. Failure to produce the booking confirmation will result in refusal to avail car parking services and cancellation of the booking.
    • After Relevant Car Parking receives a booking, the Customer will receive an email confirming receipt of the booking. If You do not receive an email, contact Relevant Car Parking before trying to place another booking.
    • All payments as mentioned and confirmed by Relevant Car Parking shall be paid through the Mobile Application only.
    • We act as an intermediary and an aggregator for providing the state of art digital infrastructure to the respective Relevant Car Parking. We do not own or operate Relevant Car Parking.
  • If you have any questions, comments or concerns regarding Relevant Car Parking’s booking acceptance policy, or if you consider that your order was rejected in error, please contact Relevant Car Parking.

Cancellation and Refund

A full refund will be provided if you cancel your booking at least 4 hours before the designated entry time.

No refund will be issued for cancellations made within 4 hours of the designated entry time.

We will not be responsible for any refund due to change in flight schedules, flight cancellation, etc., and bears no liability in respect of any such changes.

No warranties

The Website/Mobile Application and the car parking services are provided on an "as is" basis. We do not make any other representations or warranties of any kind, express or implied, including without limitation that the Website/Mobile Application or the car parking services will meet Your requirements, will always be available, accessible, uninterrupted, timely, secure, or operate without error.

Indemnity

You shall indemnify and hold harmless Us, and Our owner(s), licensee(s), affiliate(s) (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable fees of attorneys', made by any third party or penalty imposed due to or arising out of Your breach of these T&C, our privacy policy and other terms and conditions, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

Limitation of liability

In no event shall We be liable for any special, incidental, indirect or consequential damages of any kind in connection with these T&C, even if the User has been informed in advance of the possibility of such damages. For example, You waive nominal damages, liquidated damages, statutory damages, consequential damages, presumed damages, as well as the imposition of costs and attorney’s fees.

Governing law and Jurisdiction

Mumbai Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Mumbai.

Ahmedabad Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Ahmedabad.

Jaipur Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Jaipur.

Lucknow Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Lucknow.

Thiruvananthapuram Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Thiruvananthapuram.

Mangaluru Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Mangaluru.

Guwahati Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Guwahati.
