Terms and Conditions (T&C) – Scan&Pay Terms and Conditions (T&C) – Scan&Pay

These Terms & Conditions (“T&C”) are an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000 and the rules made thereunder and the amended provisions pertaining to electronic documents / records in various statutes as amended by the Information Technology Act, 2000. These T&C do not require any physical, electronic, or digital signature.

This document is published and shall be construed in accordance with the provisions of rule 3 (1) of the Information Technology (Intermediaries’ Guidelines) Rules, 2011 prescribed under Information Technology Act, 2000 that require publishing the rules and regulations, our privacy policy and user agreement for access or usage of the website.

Please read these T&C carefully. By using the website, you indicate that you understand, agree and consent to these T&C. You hereby provide your unconditional consent or agreement to as provided under section 43a and section 72a of Information Technology Act, 2000, the Information Technology (Intermediary Guidelines) Rules, 2011.

These T&C of the website located at the URL https://www.adanione.com, mobile sites or mobile application (“Website”) is between Adani Digital Labs Private Limited (“ADL” or “We” or “Us” or “Our") and the guest users or registered users of the Website ("You" or "Your" or "Yourself", “User” or "Customer") describe the terms on which You access the Website and such other services as are incidental and ancillary thereto.

These T&C is a contract between You and ADL. These T&C shall be read together with the privacy policy or other terms and condition with all other notices, disclaimers, guidelines appearing on the Website from time to time (collectively referred to as "Agreement(s)") constitute the entire agreement upon which You are allowed to access and use the Website and avail the Scan&Pay services. These T&C are subject to change/modification without any prior intimation to the User. Users are advised to check for updates on the Website.

We act as a facilitator and merely provides an online platform to the User to select the Scan&Pay Service to pay for services being offered by the Relevant Outlet/Service Provider. The details available on the Website is only for the use and information purpose and there is no advertisement, personal communication, solicitation, invitation or inducement of any sort whatsoever by Us.

The present T&C are with respect to the Scan&Pay Services offered at various Service Outlets/Service Providers being operated at Ahmedabad, Guwahati, Lucknow, Mangalore, Mumbai, Thiruvananthapuram and Jaipur Airports. (herein after referred to as “Relevant Outlet/Service Provider/Service Provider”)

Personal information:

  • We are dedicated to protecting the privacy and confidentiality of your personal information. We never rent or sell your details to any third party. Your data is stored securely on our database and will only be disclosed to our trusted partners upon your express consent for your better experience in using our App, products & services. You may refer to the Privacy Policy available on the Website for more details.

Our Role and Limitation of Liability:

  • We are only providing an online platform service for the Customer and Relevant Outlet/Service Provider to connect with each other. ADL does not, at any point of time, during any of the transactions between the Customer and Relevant Outlet/Service Provider take ownership of the Outlet/Service Provider services offered at Relevant Outlet/Service Provider.
  • ADL shall not, at any point of time, be held responsible for the safety or security of any belongings available at the time of availing Outlet/Service Provider services offered at Relevant Outlet/Service Provider.
  • Each booking submitted constitutes an offer to avail the Scan&Pay Services to make payment for services of the Relevant Outlet/Service Provider. Bookings are subject to the following terms
    • You will scan the QR code and reach the landing page of the Relevant Outlet/Service Provider on the Adani One app. If you are not logged in to the Adani One app, you shall register yourself, log in and scan the QR code placed at the Relevant Outlet/Service Provider to make the payment. 
    • You will enter the bill amount at the checkout page and select the applicable offer. Once You ‘Apply’ the offer, the discount shall be applied, and you shall pay the discounted amount.
    • The amount to be entered on the payment screen is at your discretion. If you enter a lower amount, it will be the responsibility of the Relevant Outlet/Service Provider to collect the pending amount and settle the expense. If You enters a higher amount, it will be the responsibility of the Relevant Outlet/Service Provider to give back the extra amount to You. ADL has no liability from you in this regard.
    • You can collect the invoice from the Relevant Outlet/Service Provider after showing payment proof.
    • Cancellations and refunds shall not be entertained after an order is placed
    • If on some occasions, real time payment confirmation is not received from the Payment Gateway: polling for payment status will be done every 15 seconds and if the payment is not received in 90 seconds, payment will be failed, and any deducted amount shall be refunded back to You by your Bank.
    • All payments as mentioned and confirmed by Relevant Outlet/Service Provider shall be paid through the Mobile Application only and Scan&Pay mode.
  • We act as an intermediary and an aggregator for providing the state of art digital infrastructure to the respective Relevant Outlet/Service Provider. We do not own or operate Relevant Outlet/Service Provider.
  • If you have any questions, comments or concerns regarding Relevant Outlet/Service Provider’s booking acceptance policy, services, quality etc., or if you consider that your order was rejected in error, please contact Relevant Outlet/Service Provider.

Cancellation and Refund

Cancellations and refunds shall not be entertained after an order is placed.

No warranties

The Website/Mobile Application and the Scan&Pay services are provided on an "as is" basis. We do not make any other representations or warranties of any kind, express or implied, including without limitation that the Website/Mobile Application or the Scan&Pay services will meet Your requirements, will always be available, accessible, uninterrupted, timely, secure, or operate without error.

Indemnity

You shall indemnify and hold harmless Us, and Our owner(s), licensee(s), affiliate(s) (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable fees of attorneys', made by any third party or penalty imposed due to or arising out of Your breach of these T&C, our privacy policy and other terms and conditions, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

Limitation of liability

In no event shall We be liable for any special, incidental, indirect or consequential damages of any kind in connection with these T&Cs, even if the User has been informed in advance of the possibility of such damages. For example, you waive nominal damages, liquidated damages, statutory damages, consequential damages, presumed damages, as well as the imposition of costs and attorney’s fees.

Governing law and Jurisdiction

Mumbai Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Mumbai.

Ahmedabad Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Ahmedabad.

Jaipur Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Jaipur.

Lucknow Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Lucknow.

Thiruvananthapuram Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Thiruvananthapuram.

Mangaluru Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Mangaluru.

Guwahati Airport

These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts and tribunals of Guwahati.
